Terms and Conditions

These Terms and Conditions are voluntarily set between the Learner (“The Learner”) and BikeSAFE Motorcycle Training and/or its instructors (“BikeSAFE”).

1. Acknowledgement of Risk
  • Riding a motorcycle is inherently dangerous and may result in injury, damage, or loss (to person and/or property).
  • Risks may arise from The Learner’s actions, the actions of others, or the inherent nature of riding.
  • The Learner participates in training entirely at their own risk.
  • This does not affect statutory rights.
2. Liability
  • BikeSAFE instructors are committed to safety and quality instruction.
  • BikeSAFE accepts no responsibility for negligent or reckless behaviour by The Learner.
  • The Learner agrees not to hold BikeSAFE liable for any damage or injury incurred during training.
3. Fitness to Ride
  • The Learner confirms they are medically and physically fit to ride a motorcycle.
  • The Learner declares they have no conditions that prevent participation in training.
4. Financial Liability for Damage
  • The Learner is responsible for any damage caused to BikeSAFE property while under instruction.
  • Liability is capped at AU$1,000 (One Thousand Australian Dollars) per incident.
  • If a motorcycle is dropped and sustains minor damage (e.g. handlebars, levers), a fixed AU$100 fee will apply.
  • In the event of damage to third-party property, The Learner is solely responsible for restitution to the owner.
5. Conduct During Training
  • The Learner is responsible for the safe operation of the motorcycle.
  • The Learner must not operate in any manner that contravenes the law.
  • The Learner agrees to follow Instructor directions at all times.
6. Refunds, Cancellations & Rescheduling
  • BikeSAFE does not provide refunds unless mutually agreed with The Learner.
  • BikeSAFE may cancel or reschedule lessons/assessments with prior notice by phone or electronically.
  • Assessments take priority over lessons. Lessons may be rescheduled if conflicts arise.
  • A minimum of 24 hours’ notice is required for cancellations, otherwise the full lesson fee may be charged.
7. Training Outcomes
  • BikeSAFE makes no guarantee that The Learner will pass any Department of Transport assessment.
8. Compliance Requirements
  • Non-compliant motorcycles or riders will not be permitted to train.
  • All fees will be forfeited in such cases.
9. Instructor Accreditation
  • All BikeSAFE instructors are Certificate IV qualified.
  • All instructors are accredited by the Western Australian Department of Transport.
10. Payments
  • Accepted payment methods: Cash, Bank Transfer, Credit Card.
  • A 2% surcharge applies to credit card payments.
11. Acceptance of Terms

A hard copy of the indemnity form is available for download.

By participating in BikeSAFE training, The Learner acknowledges and accepts these Terms and Conditions.
